Rather superb post, genuinely helpful stuff. Never ever believed I'd obtain the tips I want right here. I have been looking everywhere in the internet for a while now and had been starting to get frustrated. Thankfully, I happened across your website and received exactly what I had been searching for.

This is a brilliant post. As an entrepreneur (my last company sold for $16M, although I personally realized only a small fraction of that), I agree with the comparisons made here.

Interestingly, I find the comparison valid in many ways if one substitutes "entrepreneur" with "IT" and "lawyer" with "auditor", and this is very germane to the poor interaction that exists within large enterprises between IT and Finance (which is usually audit focused).

On the other hand, the higher echelons of IT - "enterprise architecture" - is more similar to the "lawyer" role in the post here, because enterprise architects tend to be very process focused and very disdainful of the business side which is generally ignorant of technology.

I will. But remember, I didn't say that there aren't classes on negotiation in law school. I said that it wasn't a required part of the curriculum. As such, not all students take it - and those that don't aren't prohibited from doing negotiations later without any formal training.

I am glad to learn from others that negotiation (and other forms of ADR) are being taught - and in some cases, significantly pressed upon the students - in law schools around the country. :)

Jeff, you are quite welcome and I am sure people will find it enlightening. You in particular might want to listen to Mr. Kaplan's interview, which posts later today. He takes issue with some of what you said about training lawyers on negotiation in law school - a course he teaches!
